📜 Terms & Conditions (T&C)
§ 1 Scope of Application towards Consumers and Definitions
(1) The following General Terms and Conditions apply to all deliveries between us and a consumer in the version valid at the time of the order.
A consumer is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to their commercial nor to their self-employed professional activity (§ 13 German Civil Code, BGB).
§ 2 Conclusion of Contract, Storage of the Contract Text
(1) The following provisions on the conclusion of the contract apply to orders placed via our online shop https://www.christians-shop.de.
(2) In the event of conclusion of a contract, the contract is concluded with
Christians Technikshop GmbH
Jöllenbecker Str. 180
D-32130 Enger
(3) The presentation of goods in our online shop does not constitute a legally binding offer on our part, but merely a non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer submits a binding offer to conclude a purchase contract.
(4) When an order is received in our online shop, the following provisions apply: The consumer submits a binding contractual offer by successfully completing the order procedure provided in our online shop.
The order is placed in the following steps:
- Selecting the desired goods
- Confirming by clicking the “Add to cart” button
- Reviewing the details in the shopping cart
- Clicking the “Proceed to order” button
- Logging into the online shop after registration and entering the login data (e-mail address and password), or ordering as a guest
- Once again reviewing or, if necessary, correcting the respective data entered
- Bindingly submitting the order by clicking the “Order with obligation to pay” button
Before bindingly submitting the order, the consumer can return to the web page on which the customer’s details are recorded by using the “Back” button of the internet browser they are using, after checking their details, and correct input errors, or cancel the order process by closing the internet browser.
We confirm receipt of your order without undue delay and automatically by e-mail. This automatic confirmation of receipt merely documents that your order has been received by us and does not yet constitute acceptance of your contractual offer.
A purchase contract is only concluded once we expressly confirm your offer in text form (e.g. by a dispatch confirmation) or dispatch the ordered goods to you.
In the case of payment by advance transfer (prepayment), we will request payment from you after receipt of your order. This request for payment is merely a request for advance payment and does not yet constitute acceptance of your offer; in this case, too, the contract is only concluded upon our express confirmation or dispatch of the goods. If no contract is concluded, we will refund any payments already made without undue delay.
(5) Storage of the contract text for orders via our online shop: We store the contract text and send you the order data, the cancellation policy and our Terms and Conditions by e-mail. You can also view the Terms and Conditions at any time at https://www.christians-shop.de/en/terms. You can view your past orders in our customer area under “My account” → “My orders”.
§ 3 Prices, Shipping Costs, Payment, Due Date
(1) The stated prices include statutory value added tax and other price components. Any shipping costs are added. Any shipping costs incurred are shown separately during the order process before the order is submitted.
(2) The payment methods displayed during the order process are available to the consumer, in particular advance transfer (prepayment) and PayPal.
(3) If the consumer has chosen payment by advance transfer (prepayment), they undertake to pay the purchase price without undue delay after conclusion of the contract.
§ 4 Delivery, Delivery Times, Reservation of Self-Supply
(1) The delivery time for the respective item is stated in the product description in the online shop. If you order several items with different delivery times in one order, we will deliver the goods in a single shipment, unless we have agreed otherwise with you. In this case, the delivery time for the entire order is determined by the item with the longest stated delivery time.
(2) The stated delivery times are estimated times. The running of a stated delivery time begins, in the case of payment by advance transfer, on the day after the payment order is issued to the remitting bank, and for the other payment methods on the day after conclusion of the contract. If the end of the period falls on a Saturday, Sunday or public holiday at the place of delivery, the period ends on the next working day. If no delivery time is stated for an item, we will deliver the goods without undue delay, but no later than within 30 days.
(3) Delivery is carried out by shipping service providers commissioned by us. We have only limited influence on the duration of delivery by the shipping service provider; delays caused thereby for which we are not responsible cannot be excluded.
(4) Reservation of self-supply: If, through no fault of our own, we are not supplied or not supplied on time by our supplier, although we concluded a corresponding (congruent) covering transaction before conclusion of the contract, we are entitled to withdraw from the contract. In this case, we will inform you without undue delay and refund any payments already made without undue delay.
(5) The risk of accidental loss and accidental deterioration of the sold item passes to you only upon handover of the item to you, even in the case of a sale by dispatch.
§ 5 Retention of Title
We retain title to the goods until the purchase price has been paid in full.
§ 6 Right of Withdrawal
Consumers have a statutory right of withdrawal. You can find the detailed cancellation policy and the model withdrawal form on our “Right of Withdrawal” page at https://www.christians-shop.de/en/right-of-withdrawal. There you will also find an online withdrawal form through which you can declare your withdrawal directly by electronic means. The cancellation policy will additionally be provided to you in text form at the latest with the order confirmation.
§ 7 Liability for Defects (Warranty)
The statutory provisions on liability for defects apply.
§ 8 Consumer Dispute Resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 German Consumer Dispute Resolution Act, VSBG).
§ 9 Contract Language and Governing Version
The contract is concluded exclusively in German. This English translation of these General Terms and Conditions is provided for information purposes only and is non-binding. Only the German version is legally binding; in the event of any discrepancies between the German and English versions, the German version shall prevail.
